TeddyBridge Terms of Service

1. Agreement to Terms

By accessing or using TeddyBridge through our iOS application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and TeddyBridge ("we," "our," or "us"), a 501(c)(3) nonprofit organization.

2. Description of Service

TeddyBridge is a peer-to-peer patient support platform that connects individuals with foot and ankle conditions. The Service facilitates connections between patients through peer matching, in-app messaging, and video/voice calls for the purpose of sharing experiences, providing emotional support, and exchanging information about recovery.

The Service is not a healthcare provider and does not offer medical advice, diagnosis, or treatment.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Account Registration

To use the Service, you must create an account using email and password, Sign in with Apple, or Sign in with Google. You agree to provide accurate and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Provide medical advice, diagnosis, or treatment recommendations to other users
  • Share false, misleading, or harmful health information
  • Harass, threaten, bully, intimidate, or abuse other users in messages or on calls
  • Use abusive, discriminatory, hateful, or threatening language
  • Impersonate any person or entity or misrepresent your identity or condition
  • Share another user's personal or health information outside the platform
  • Send unsolicited promotional content or spam through messaging
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Use the Service for any commercial purpose without our prior written consent
  • Record, screenshot, or redistribute the content of video or voice calls without the other participant's consent
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service in any way that violates applicable laws or regulations

6. User Content

You retain ownership of any content you submit, post, or share on the Service ("User Content"), including messages, profile information, and bio. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display such content solely in connection with operating and providing the Service.

You are solely responsible for your User Content and represent that it is accurate and that you have the right to share it. We do not endorse any User Content and are not responsible for its accuracy or reliability.

7. Community Safety

TeddyBridge is committed to a safe and supportive environment. The Service includes the ability to block and report other users. If you experience harassment, abuse, or any behavior that violates these Terms, you can block the user and report the behavior through the app.

We review reports and may take action including warning the user, suspending their account, or permanently removing them from the platform. We reserve the right to remove any content or terminate any account that violates these Terms or threatens the safety of our community.

8. Video and Voice Calls

The Service allows matched peers to schedule and join video and voice calls. These calls are facilitated through a third-party provider (Daily.co). Calls are not recorded by TeddyBridge. You are responsible for your conduct during calls and agree to follow the same standards of behavior outlined in Section 5.

You acknowledge that calls require access to your device's camera and microphone, and that you will be prompted to grant these permissions. You may revoke these permissions at any time through your device settings.

9. Push Notifications

The Service uses push notifications to alert you to new messages, upcoming calls, and account activity. You can manage notification preferences through your iOS device settings at any time.

10. Privacy

Your use of the Service is subject to our Privacy Policy, which is available at https://www.teddybridge.com/privacy and is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

11. Medical Disclaimer

THE SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

The information and peer connections provided through the Service are for informational and emotional support purposes only. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of something you have read, heard, or discussed on the Service.

If you think you may have a medical emergency, call your doctor or emergency services immediately. TeddyBridge does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on the Service.

Users who provide peer support are sharing personal experiences, not professional medical opinions. Their experiences may not be representative of your outcome.

12. Apple App Store Terms

The Service is available through the Apple App Store. You acknowledge and agree to the following:

  • These Terms are between you and TeddyBridge, not Apple. TeddyBridge is solely responsible for the Service and its content.
  • Apple has no obligation to provide maintenance or support for the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund any applicable purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
  • Apple is not responsible for addressing any claims by you or any third party relating to the Service, including product liability claims, claims that the Service fails to meet legal or regulatory requirements, and consumer protection claims.
  • In the event of any third-party claim that the Service or your possession and use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of such claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
  • You must comply with any applicable third-party terms of agreement when using the Service.

13. Intellectual Property

The Service and its original content, features, functionality, and design are owned by TeddyBridge and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

14. Third-Party Services

The Service uses third-party services including Supabase (authentication and hosting) and Daily.co (video calls). We are not responsible for the availability, content, or practices of these third-party services. Your use of these services may be subject to their own terms and privacy policies.

15. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, if you breach these Terms or engage in behavior that threatens the safety of our community. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through the app settings.

16. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

PEER CONNECTIONS AND CONVERSATIONS ON THE SERVICE ARE BETWEEN INDIVIDUAL USERS. WE DO NOT SCREEN, VERIFY, OR ENDORSE THE MEDICAL ACCURACY OF ANY INFORMATION SHARED BETWEEN PEERS.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEDDYBRIDGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESS TO THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

18. Indemnification

You agree to indemnify, defend, and hold harmless TeddyBridge and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.

19. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Boston, Massachusetts, in accordance with the rules of the American Arbitration Association.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and within the app. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
